International Returns

This page explains the additional procedures, shipping responsibilities, customs requirements, and refund considerations that may apply when merchandise is returned to Sylvie Silk from outside the United States.

Sylvie Silk is operated by EVELYN SYLVIE Inc., doing business as SYLVIE SILK, located at 627 Locust Street, Roselle, New Jersey 07203, United States.

  1. Scope of This Policy

This policy applies to merchandise returned from a country or territory outside the United States.

It should be read together with our:

  • Returns & Exchanges
  • International & EU Shipping
  • Duties, Taxes & VAT
  • Customs & Import Restrictions
  • EU Right of Withdrawal
  • Terms of Use & Sale

When mandatory consumer law provides greater rights than this policy, those mandatory rights will apply.

  1. Return Eligibility

A product may be eligible for an international return when:

  • the return is requested within the applicable return period;
  • the product is eligible under our Returns & Exchanges policy;
  • the customer obtains return authorization before shipping;
  • the merchandise is returned in the required condition;
  • all applicable return instructions are followed; and
  • no stated exclusion or legal restriction applies.

The applicable return period may be stated in our Returns & Exchanges policy, the product description, the order confirmation, or other information presented before purchase.

A return request is not approved merely because merchandise has been mailed back to Sylvie Silk.

  1. Requesting Return Authorization

Before sending an international return, contact:

returns@sylviesilk.com

Please provide:

  • order number;
  • purchaser’s name;
  • product being returned;
  • reason for the return;
  • delivery date;
  • photographs when the product is damaged, defective, incorrect, or materially different from what was ordered; and
  • any other information reasonably needed to review the request.

When the return is approved, Sylvie Silk will provide return instructions and the correct return address.

Do not send merchandise to our corporate address unless that address is specifically provided in the return authorization.

Unauthorized returns may be delayed, refused, or returned to the sender.

  1. Return Mailing Deadline

The return authorization will state the date by which the merchandise must be shipped.

The customer should retain:

  • the shipping receipt;
  • tracking number;
  • customs documentation;
  • proof of the date mailed; and
  • proof of delivery.

A return mailed after the stated deadline may be declined unless mandatory applicable law provides otherwise.

  1. Condition of Returned Merchandise

Unless the return concerns a damaged, defective, incorrect, or nonconforming product, returned merchandise must ordinarily be:

  • unused;
  • unworn;
  • unwashed;
  • unaltered;
  • free from stains, odors, cosmetics, hair products, pet hair, or other contamination;
  • accompanied by its original labels and accessories; and
  • packaged appropriately to prevent damage during international transportation.

Opening packaging only to inspect a product does not necessarily make the product ineligible for return. However, handling beyond what is reasonably necessary to inspect its nature, characteristics, fit, or condition may affect the amount of any refund where permitted by applicable law.

  1. Products With Limited or No Voluntary Return Eligibility

The following products may be excluded from voluntary change-of-mind returns when the exclusion is disclosed before purchase and permitted by applicable law.

Customized or Personalized Products

Products made or altered according to the customer’s individual specifications may not be eligible for a voluntary return.

This may include merchandise with personalized measurements, embroidery, monograms, custom colors, custom combinations, or other customer-selected modifications that are not part of the standard product offering.

Fabric Cut to a Requested Length

Silk fabric cut from a bolt according to the customer’s requested quantity may have limited return eligibility.

Any applicable restriction will be disclosed before the order is submitted. A cut-length fabric order will not automatically lose rights relating to damage, defects, incorrect fabric, incorrect quantity, material misdescription, or other nonconformity.

Sealed or Hygiene-Sensitive Merchandise

A sealed product may have limited return eligibility after its protective seal has been removed when the nature of the merchandise and applicable law permit such a restriction.

Sylvie Silk will not classify a product as nonreturnable for hygiene reasons unless the restriction is appropriate to the product and disclosed before purchase.

Final-Sale Merchandise

A product clearly identified as Final Sale before purchase may be ineligible for a voluntary return where permitted by applicable law.

A final-sale designation does not eliminate mandatory rights concerning defective, damaged, incorrect, misdescribed, or otherwise nonconforming merchandise.

  1. Damaged, Defective, Incorrect, or Nonconforming Merchandise

Contact returns@sylviesilk.com promptly when merchandise:

  • arrives damaged;
  • contains a manufacturing defect;
  • differs materially from its description;
  • is not the product ordered;
  • is missing an included component; or
  • arrives in an incorrect quantity, color, size, or fabrication.

Preserve the Packaging

Please retain the merchandise, shipping carton, protective materials, labels, and carrier documentation until Sylvie Silk confirms whether they are needed for inspection or a carrier claim.

Photographs and Supporting Information

Sylvie Silk may request photographs of:

  • the product;
  • the affected area;
  • packaging;
  • shipping label;
  • product label; and
  • visible transportation damage.

Do not discard damaged merchandise or packaging before receiving instructions.

When Sylvie Silk confirms that it supplied damaged, defective, incorrect, or nonconforming merchandise, Sylvie Silk will provide an appropriate remedy subject to applicable law. The remedy may include repair, replacement, refund, or another mutually agreed resolution.

  1. International Return Shipping Costs

For a voluntary return unrelated to a Sylvie Silk error or product nonconformity, the customer is ordinarily responsible for:

  • return transportation;
  • tracking;
  • insurance;
  • packaging;
  • customs documentation;
  • brokerage or clearance charges; and
  • other costs associated with returning the merchandise.

Sylvie Silk will be responsible for reasonable authorized return expenses when required by applicable law or when Sylvie Silk confirms that the return resulted from an incorrect, damaged, defective, or materially nonconforming product.

Do not purchase an unusually expensive return service without written approval if reimbursement is expected.

  1. Shipping Method, Tracking, and Insurance

International returns should be sent through a reliable, trackable shipping service.

The customer should:

  • obtain a tracking number;
  • retain proof of mailing;
  • package the merchandise securely;
  • use adequate insurance for valuable merchandise;
  • comply with carrier restrictions; and
  • monitor the shipment until delivery.

For customer-paid voluntary returns, Sylvie Silk is not responsible for merchandise lost, stolen, delayed, damaged, or misdirected before it is delivered to the authorized return location, except where applicable law provides otherwise.

  1. Customs Documentation for Returned Merchandise

International returns must include accurate customs and shipping documentation.

The customer should follow the return instructions provided by Sylvie Silk and identify the shipment accurately as returned merchandise when appropriate.

The customer must not:

  • identify the return as a commercial gift;
  • enter a false or artificially reduced value;
  • provide an inaccurate country of origin;
  • use a misleading product description;
  • omit merchandise from the declaration; or
  • otherwise provide false customs information.

Incorrect or incomplete documentation may result in delay, refusal, additional duties, brokerage fees, storage charges, or return of the shipment to the customer.

  1. Customs Duties, VAT, Taxes, and Brokerage Fees

A customer may have paid customs duties, import VAT, taxes, brokerage fees, or other charges when the original order entered the destination country.

Sylvie Silk can refund only those charges that:

  1. were collected directly by Sylvie Silk; and
  2. are refundable under applicable law and the terms governing the return.

When import charges were paid directly to a customs authority, tax authority, carrier, postal operator, or customs broker, the customer may need to request reimbursement directly from that organization.

Eligibility, documentation, deadlines, and refund amounts are determined by the applicable authority or service provider. Brokerage, clearance, disbursement, processing, and administrative fees may be nonrefundable.

  1. Charges Imposed When the Return Reenters the United States

Internationally returned merchandise may be reviewed by United States customs authorities when it reenters the country.

The customer must follow the return instructions and provide sufficient documentation identifying the shipment as returned merchandise. Improper documentation may cause Sylvie Silk to incur duties, taxes, brokerage fees, storage charges, or other expenses.

To the extent permitted by applicable law, costs caused by inaccurate documentation or failure to follow return instructions may be deducted from the refund.

The fact that an item is being returned does not guarantee that a carrier or customs authority will process it without requesting additional documentation.

  1. Refund Review and Inspection

After the return is delivered, Sylvie Silk will inspect the merchandise and verify:

  • product identity;
  • quantity;
  • condition;
  • completeness;
  • compliance with return instructions; and
  • whether any reduction is permitted or required.

Sylvie Silk will notify the customer when the return has been approved, declined, or requires additional information.

An approved refund will ordinarily be issued to the original payment method.

  1. Refund Amount

For an eligible voluntary return, the refund may include the purchase price of the accepted returned merchandise.

Unless required by applicable law or stated otherwise:

  • original international shipping charges are not refundable;
  • expedited-shipping surcharges are not refundable;
  • customer-paid return shipping is not refundable;
  • brokerage and carrier fees are not refundable by Sylvie Silk unless Sylvie Silk collected them; and
  • nonrecoverable costs caused by an unauthorized, refused, or incorrectly documented return may be deducted where permitted.

No deduction will be made merely because the customer reasonably inspected the merchandise. A deduction may apply for damage, wear, alteration, contamination, missing components, or handling beyond what is reasonably necessary, subject to applicable law.

  1. Refund Timing

After an eligible return is received and approved, Sylvie Silk will initiate the refund within the period required by applicable law.

The customer’s bank, card issuer, or payment provider may require additional time to post the refund.

Sylvie Silk does not control processing times imposed by financial institutions, payment networks, customs authorities, or carriers.

  1. Currency Conversion and Exchange-Rate Differences

Refunds are issued in the currency and amount processed by Sylvie Silk, subject to the original transaction and payment method.

When the customer’s financial institution converted the purchase into another currency:

  • the refund may be converted using a different exchange rate;
  • the final amount shown on the customer’s statement may differ from the original converted amount; and
  • foreign-transaction or currency-conversion fees may not be refunded by the financial institution.

Sylvie Silk does not control exchange rates or charges imposed independently by a bank, card issuer, or payment provider.

  1. International Exchanges

Direct international exchanges may not be available for all products or destinations.

When a different size, color, product, or fabrication is requested, Sylvie Silk may process the original item as a return and ask the customer to place a new order.

This approach allows the replacement order to receive its own:

  • inventory confirmation;
  • shipping charge;
  • customs documentation;
  • declared value;
  • duties and taxes; and
  • tracking information.

When Sylvie Silk supplied an incorrect or nonconforming product, replacement arrangements will be handled according to the circumstances and applicable law.

  1. Refused, Unclaimed, or Undeliverable Shipments

A shipment that is refused, unclaimed, incorrectly addressed, or returned because import charges were not paid is not automatically treated as an approved return.

When such merchandise is returned to Sylvie Silk:

  • the package must first be received and inspected;
  • the product must remain eligible for refund;
  • customs and carrier charges may be assessed; and
  • nonrecoverable expenses may be deducted where permitted by applicable law.

This section does not limit rights relating to merchandise that was damaged, defective, incorrect, misdescribed, or otherwise nonconforming when supplied.

  1. Freight Forwarders and Reshipping Services

When a customer directs an order to a freight forwarder, package-consolidation service, hotel, commercial receiving agent, or international reshipper, additional return limitations may apply.

The customer remains responsible for:

  • the forwarding arrangement;
  • accuracy of the final destination information;
  • customs and import compliance after forwarding;
  • transportation from the intermediary to the final recipient; and
  • returning the merchandise from its actual location.

Delivery to the customer’s selected intermediary may constitute delivery of the original Sylvie Silk shipment, subject to mandatory applicable law.

  1. European Union Orders

Sylvie Silk does not currently accept orders for delivery to the European Union.

Before EU sales are enabled, this page will be reviewed and updated to coordinate with the EU Right of Withdrawal page and applicable national requirements.

EU consumers purchasing eligible goods online generally have 14 days after delivery to notify the seller of withdrawal. They generally then have another 14 days to return the goods. The customer ordinarily bears the direct cost of return when informed beforehand, while the seller must reimburse qualifying payments within the applicable period and may generally wait until the goods or evidence of return is received. Exceptions and rules concerning diminished value may apply.

The statutory withdrawal right is separate from rights concerning defective or nonconforming goods. EU rules provide mandatory legal remedies for goods that do not conform to the contract.

Sylvie Silk’s commercial return policy will not limit any nonwaivable EU consumer rights once EU sales are activated.

  1. Other Mandatory Consumer Rights

Consumer laws differ among countries and territories.

Nothing in this policy excludes, restricts, or replaces a right or remedy that cannot lawfully be waived or limited.

Where this policy conflicts with mandatory applicable consumer law, the mandatory law will control to the extent of the conflict.
