EU Right of Withdrawal

  1. Purpose of This Policy

This page explains the statutory right of withdrawal that may apply to eligible consumers in the European Union who purchase products from SYLVIE SILK through sylviesilk.com.

This right is separate from rights concerning damaged, defective, incorrect, or nonconforming goods.

Nothing in this policy limits a consumer right that cannot lawfully be excluded or restricted.

  1. The 14-Day Withdrawal Period

Where the statutory right of withdrawal applies, an eligible EU consumer may withdraw from an online purchase within 14 calendar days without providing a reason.

For an order containing one product, the withdrawal period ordinarily begins on the day after the consumer, or a third party designated by the consumer other than the carrier, receives the product.

If several products purchased in one order are delivered separately, the period ordinarily begins on the day after the last product is received.

If one product is delivered in several lots or pieces, the period ordinarily begins on the day after the final lot or piece is received.

  1. How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the consumer must notify us of the decision to withdraw before the withdrawal period expires.

The notice must be a clear statement identifying the order or contract and communicating the decision to withdraw.

The consumer may use the model withdrawal form appearing below, but use of that form is not mandatory. A different clear and unequivocal statement is sufficient.

The deadline is met when the withdrawal communication is sent before the 14-day withdrawal period expires.

  1. Online Withdrawal Function

Where required by applicable EU law, Sylvie Silk will provide an easily accessible online withdrawal function labeled:

The function will remain available during the applicable withdrawal period.

After the customer enters the required information, the final submission control will be labeled:

The online process will request information reasonably necessary to identify the consumer and the applicable order or contract, together with an electronic contact method for confirmation.

After submission, Sylvie Silk will send an electronic acknowledgment containing the withdrawal information and the date and time of submission without undue delay.

EU measures implementing the online-withdrawal-function requirement apply from June 20, 2026. The function must be prominently displayed, easy to access, and continuously available during the withdrawal period.

  1. Returning the Products

After notifying Sylvie Silk of the withdrawal, the consumer must return the eligible products without undue delay and no later than 14 calendar days after communicating the decision to withdraw.

We will provide the appropriate return address and instructions after receiving the withdrawal notice.

Unless Sylvie Silk agrees to pay the return cost, or applicable law requires otherwise, the consumer is responsible for the direct cost of returning the products.

Products should be returned securely packaged. We strongly recommend using a tracked and insured delivery service appropriate to the product’s value.

The return deadline is met if the consumer sends the products before the 14-day return period expires.

  1. Condition and Permitted Inspection

A consumer may inspect a product to the extent reasonably necessary to establish its nature, characteristics, and functioning.

The consumer may be responsible for any diminished value caused by handling beyond what would reasonably be permitted when examining the product in a physical retail store.

For silk products, excessive handling may include, depending on the circumstances:

  • wearing or using the product beyond a reasonable inspection;
  • washing, ironing, steaming, cutting, sewing, altering, staining, or damaging it;
  • removing permanently attached labels;
  • exposing the product to perfume, cosmetics, smoke, moisture, or other substances;
  • returning fabric or an accessory in materially altered condition; or
  • failing to package the product reasonably for return transit.

Any deduction for diminished value will be assessed reasonably and in accordance with applicable law.

  1. Refunds

Where a valid statutory withdrawal applies, Sylvie Silk will reimburse eligible payments without undue delay and no later than 14 days after receiving notice of withdrawal.

For product sales, we may withhold reimbursement until:

  • we receive the returned products; or
  • the consumer provides evidence that the products were sent back,

whichever occurs first.

The refund will ordinarily be issued using the same payment method used for the original transaction, unless the consumer expressly agrees otherwise and does not incur additional fees.

Where required, the refund will include the cost of the least expensive standard delivery method offered for the order.

Additional costs resulting from the consumer’s selection of expedited, premium, or another more expensive delivery option are not required to be reimbursed.

  1. Products That May Be Excluded

The statutory right of withdrawal does not apply to every product.

Subject to applicable law and the particular facts of the transaction, exclusions may include:

Goods Made to the Consumer’s Specifications

Products made according to individual customer specifications or clearly personalized products may be excluded.

Examples may include:

  • monogrammed or personalized products;
  • custom dimensions;
  • individually commissioned designs;
  • products made in a customer-selected configuration that is not part of the ordinary standard offering; or
  • other goods produced specifically for that consumer.

Cut-Length Fabric

Sylvie Silk will not automatically treat every fabric purchase as exempt merely because the fabric was cut from a larger roll.

Whether fabric cut to a customer-selected length legally qualifies as goods made to the consumer’s specifications may depend on the product, the selection process, applicable national law, and the facts of the order.

Where Sylvie Silk intends to rely on the made-to-specification exception, that information will be stated clearly on the applicable product page and before the order is submitted.

Sealed Hygiene-Sensitive Goods

Certain sealed goods that are genuinely unsuitable for return for health-protection or hygiene reasons may be excluded after the seal is broken.

This exception will be used only where the legal requirements are satisfied and the customer was informed before purchase.

A silk pillowcase, headband, scarf, or other product will not automatically be considered nonreturnable merely because it has been opened.

Other Statutory Exceptions

Other exceptions may apply where expressly provided by applicable law.

EU rules specifically recognize exceptions for goods made to the consumer’s specifications or clearly personalized goods, and for certain sealed goods unsuitable for return for health or hygiene reasons after unsealing.

  1. Damaged, Defective, Incorrect, or Nonconforming Goods

The statutory right of withdrawal is not the same as a claim involving a damaged, defective, incorrect, incomplete, or nonconforming product.

If a product arrives damaged, defective, materially different from the description, or not in conformity with the sales contract, contact us promptly at:

Please provide:

  • the customer’s name;
  • order number;
  • description of the issue;
  • photographs where appropriate; and
  • the requested resolution.

Rights concerning defective or nonconforming goods may continue even after the 14-day withdrawal period expires.

  1. Duties, Taxes, and Import Charges

Refunds of customs duties, import VAT, brokerage charges, or other amounts paid directly to customs authorities, carriers, or third parties may need to be requested from the applicable authority or service provider.

Sylvie Silk can refund only amounts actually received by Sylvie Silk, except where applicable law requires otherwise.
